EPA proposes extending PFAS compliance to 2031 and rescinding four compound standards in a major drinking water rule overhaul

US water utilities face fresh uncertainty after the Environmental Protection Agency published two proposed rules on May 20, revising the federal framework for per- and polyfluoroalkyl substances, the synthetic compounds found in drinking water supplies across the country.
The first proposal keeps enforceable limits for PFOA and PFOS at four parts per trillion. Utilities that formally apply, however, may defer compliance from April 2029 to April 2031. For thousands of systems mid-way through infrastructure planning, the extension carries real operational weight.
Also, the second goes further. Citing procedural failings in the prior administration's 2024 rulemaking, the EPA is moving to rescind standards for four PFAS compounds: PFHxS, PFNA, HFPO-DA (also known as GenX), and a mixture index that includes PFBS. The agency argues that rules built on a flawed legal process are themselves vulnerable to being struck down in court. A corrected review, it says, could produce limits equal to or stricter than those now being withdrawn. Existing standards remain legally in force in the meantime.
Legal challenges are already in motion. Environmental groups contend the Safe Drinking Water Act's anti-backsliding provision bars the agency from weakening an established standard. Separately, the American Water Works Association has active litigation in the D.C. Circuit. Several states have moved independently to set their own PFAS limits, leaving utilities to navigate a growing patchwork of obligations regardless of how the federal proposals resolve.
Public comment closes July 20, 2026. A virtual hearing is scheduled for July 7.
Alongside the rulemaking, the EPA announced nearly $1 billion in grant funding for small and disadvantaged communities, a signal that investment in water treatment remains a federal priority even as the regulatory baseline is contested.
